Terms of use and privacy policy

This Personal Data Privacy Policy (hereinafter – the Privacy Policy) applies to all information that the website https://parfumgallery.uz/, (hereinafter – parfumgallery.uz) located on the domain name parfumgallery.uz (as well as its subdomains) may obtain about the User while the User is using the parfumgallery.uz website (as well as its subdomains), its programs and its products.

1. Definition of terms

1.1 The following terms are used in this Privacy Policy:

1.1.1. "Website Administration" (hereinafter – the Administration) – employees authorised to manage the parfumgallery.uz website, who organise and (or) carry out the processing of personal data, and who also determine the purposes of processing personal data, the composition of the personal data to be processed, and the actions (operations) performed with personal data.

1.1.2. "Personal data" – any information relating to a directly or indirectly identified or identifiable natural person (the personal data subject).

1.1.3. "Processing of personal data" – any action (operation) or set of actions (operations) performed with or without the use of automation tools on personal data, including collection, recording, systematisation, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalisation, blocking, deletion and destruction of personal data.

1.1.4. "Confidentiality of personal data" – a requirement, mandatory for the Operator or any other person who has gained access to personal data, not to allow their distribution without the consent of the personal data subject or another lawful basis.

1.1.5. "The parfumgallery.uz website" – a collection of interconnected web pages placed on the Internet at a unique address (URL): https://parfumgallery.uz, as well as its subdomains.

1.1.6. "Subdomains" – pages or a collection of pages located on third-level domains belonging to the parfumgallery.uz website, as well as other temporary pages at the bottom of which the contact information of the Administration is indicated

1.1.7. "User of the parfumgallery.uz website" (hereinafter the User) – a person who has access to the parfumgallery.uz website via the Internet and who uses the information, materials and products of the parfumgallery.uz website.

1.1.8. "Cookies" – a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends to the web server each time in an HTTP request when attempting to open a page of the corresponding website.

1.1.9. "IP address" – a unique network address of a node in a computer network through which the User accesses parfumgallery.uz.

2. General provisions

2.1. The User's use of the parfumgallery.uz website constitutes consent to this Privacy Policy and to the terms of processing of the User's personal data.

2.2. If the User does not agree with the terms of the Privacy Policy, the User must stop using the parfumgallery.uz website .

3. Subject of the privacy policy

3.1. This Privacy Policy establishes the obligations of the Administration regarding non-disclosure and the provision of a regime for protecting the confidentiality of personal data that the User provides at the request of the Administration when registering on the parfumgallery.uz website or when subscribing to the informational e-mail newsletter.

3.2. Personal data permitted for processing under this Privacy Policy are provided by the User by filling in forms on the parfumgallery.uz website and include the following information:

3.2.1. the User's surname, first name and patronymic;

3.2.2. the User's contact telephone number;

3.2.4. the User's place of residence (where necessary)

4. Purposes of collecting the user's personal information

4.1. The Administration may use the User's personal data for the purposes of:

5. Methods and time limits for processing personal information

5.1. The processing of the User's personal data is carried out without any time limit, by any lawful means, including in personal data information systems with or without the use of automation tools.

5.2. The User's personal data may be transferred to the authorised state authorities of the Republic of Uzbekistan only on the grounds and in the manner established by the legislation of the Republic of Uzbekistan.

5.3. In the event of loss or disclosure of personal data, the Administration has the right not to inform the User of the loss or disclosure of personal data.

5.4. The Administration takes the necessary organisational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful acts of third parties.

5.5. The Administration, together with the User, takes all necessary measures to prevent losses or other adverse consequences caused by the loss or disclosure of the User's personal data.

6. Rights and obligations of the parties

6.1. The User has the right to:

6.1.1. Take a free decision on providing the personal data required for using the parfumgallery.uz website and give consent to their processing.

6.1.2. Update and supplement the personal data provided in the event that this information changes.

6.1.3. The User has the right to obtain from the Administration information concerning the processing of the User's personal data, unless such right is restricted in accordance with federal laws. The User has the right to demand that the Administration clarify the User's personal data, block or destroy them if the personal data are incomplete, outdated, inaccurate, unlawfully obtained or not necessary for the stated purpose of processing, and also to take the measures provided for by law to protect the User's rights. To do so, it is sufficient to notify the Administration at the specified e-mail address.

6.2. The Administration is obliged to:

6.2.1. Use the information received solely for the purposes specified in clause 4 of this Privacy Policy.

6.2.2. Keep confidential information secret, not disclose it without the prior written permission of the User, and not sell, exchange, publish or disclose in any other possible way the User's transferred personal data, except as provided in clauses 5.2. of this Privacy Policy.

6.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure normally used to protect information of this kind in existing business practice.

6.2.4. Block the personal data relating to the relevant User from the moment of an application or request by the User, or by the User's legal representative, or by the authorised body for the protection of the rights of personal data subjects, for the period of verification, in the event that inaccurate personal data or unlawful acts are identified.

7 Liability of the parties

7.1. The Administration, having failed to fulfil its obligations, is liable for the losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of the Republic of Uzbekistan, except in the cases provided for in clauses 5.2. and 7.2. of this Privacy Policy.

7.2. In the event of loss or disclosure of Confidential information, the Administration is not liable if such confidential information:

7.2.1. Became public property before its loss or disclosure.

7.2.2. Was received from a third party before it was received by the Administration of the Resource.

7.2.3. Was disclosed with the User's consent.

7.3. The User bears full responsibility for compliance with the requirements of the legislation of the Republic of Uzbekistan, including but not limited to laws on advertising, on the protection of copyright and related rights, and on the protection of trademarks and service marks, including full responsibility for the content and form of materials.

7.4. The User acknowledges that responsibility for any information (including but not limited to: data files, texts, etc.) to which the User may have access as part of the parfumgallery.uz website lies with the person who provided such information.

7.5. The User agrees that information provided to the User as part of the parfumgallery.uz website may be an object of intellectual property, the rights to which are protected and belong to other Users, partners or advertisers who place such information on the parfumgallery.uz website. The User has no right to modify, lease, lend, sell, distribute or create derivative works based on such Content (in whole or in part), except where such actions have been expressly permitted in writing by the owners of such Content in accordance with the terms of a separate agreement.

7.7. The Administration is not liable to the User for any loss or damage incurred by the User as a result of the deletion, failure or impossibility of saving any Content and other communication data contained on or transmitted through the parfumgallery.uz website.

7.8. The Administration is not liable for any direct or indirect losses arising from: the use of or inability to use the website or individual services; unauthorised access to the User's communications; statements or conduct of any third party on the website.

7.9. The Administration is not liable for any information posted by a user on the parfumgallery.uz website, including but not limited to: information protected by copyright, without the express consent of the copyright owner.

8. Dispute resolution

8.1. Before filing a claim in court over disputes arising from the relationship between the User and the Administration, it is mandatory to submit a claim (a written proposal or a proposal in electronic form for the voluntary settlement of the dispute).

8.2. The recipient of the claim, within 30 calendar days from the date of receipt of the claim, shall notify the claimant in writing or in electronic form of the results of the consideration of the claim.

8.3. If no agreement is reached, the dispute shall be referred to the Arbitration Court of Tashkent.

8.4. The current legislation of the Republic of Uzbekistan applies to this Privacy Policy and to the relationship between the User and the Administration.

9. Additional terms

9.1. The Administration has the right to make changes to this Privacy Policy without the User's consent.

9.2. The new Privacy Policy comes into force from the moment it is posted on the parfumgallery.uz website, unless otherwise provided by the new version of the Privacy Policy.
